Shana Anderson v. Eulyus "Jack" shortt and Faye Shortt[CV 06 582363]
Court:Cuyahoga County Court of Common Pleas
Judge:William Coyne
Date of Trial:
Facts:Defendants' Shi-Tzu dog bit plaintiff in the lip while plaintiff was playing with dog. Defendants admitted liability under Ohio's strict-liability dog-bite statute.
Injury/Damages:Plaintiff treated in the emergency room at St. John Westshore Hospital that evening. Plaintiff returned later that evening for stitches by plastic surgeon David Novotny, M.D. Dr. Novotny removed stitches six days later and plaintiff saw primary care physician, Isabelita Guadiz, M.D. two days later. Plaintiff's lawyer referred her to Jeffrey A. Goldstein, M.D. Plaintiff saw Dr. Goldstein on November 20, 2002, May 7, 2003, and April 7, 2004. Dr. Goldstein recommended scar revision surgery to revise a 1.5 cm. irregular scar at the corner of the plaintiff's mouth that caused discomfort, some embarrassment, and some difficulty while chewing. The scar tended to become dry in the winter. Defendants argued that if the plaintiff really needed the surgery that she would have had it already.
