| Facts: |  | Medical malpractice claim. Left hip arthroplasty performed using a cementless implant on a then 78-year old woman with severe osteoporosis. Numerous intraoperative fractures occurred which were not timely identified by the orthopedic surgeon. The patient went on to have displacement of the fractures and failure of the implant within four days. The fractures were allowed to heal on their own and she eventually sought a revision eight months later. The successful revision was performed although the plaintiff was unable to return to her pre-operative state of living independently. She has been confined to a nursing home ever since. Medical specials totaled $190,000. No consent by the physician so there was no offer. It took a six day trial with a defense verdict after 1 ½ days of deliberation.
