| Facts: |  | The Estate of Cindy Hane brought this medical malpractice/wrongful death case against Dr. Steven Ulaki, D.O., then a resident physician, Dr. Anita Gage, M.D., attending ER physician, and Doctors Hospital West. Plaintiff’s decedent had presented to the ER on February 12, 1999, with 16 different complaints, signs and symptoms. She was given IV fluid for hydration, anti nausea medication, and after four hours discharged with a diagnosis of viral influenza. She had normal vital signs, a normal pulse ox reading, and a non-productive cough.
With 18 hours, the Plaintiff’s decedent returned to the same ER, now coughing up blood. Emergency therapy was undertaken, and it was determined that the patient was suffering from bacterial pneumonia. DIC developed, and the patient died several hours thereafter. Plaintiff’s theory was that the Defendants negligently failed to detect and treat bacterial pneumonia, upon the initial ER presentation. No medical bills; funeral and burial expenses. Economic loss testimony indicated potential lost earnings of $600,000. |
